RENTAL AGREEMENT
1. The tenant hereby agrees to the occupation of the premises for their use as short term holiday accommodation for the period as set out in the attached confirmation and agree to pay for the full period prior to occupation.
2. The advanced deposit shall be non-refundable in the event of cancellation by the tenant for whatever reason. In the event of the tenant failing to pay the deposit timeously as set out in the attached confirmation, the booking shall fall away and this Agreement shall be considered cancelled by both parties.
3. The tenant lets the premises for use as a private residence only. The number of tenants is not to exceed the number set out in the attached confirmation. Additional tenants will be charged a pro-rate amount of the rental. The tenant may not sublet the premises.
4. The cost of telephone and Internet services provided during the period of occupancy is for the tenants account.
5. During the period of occupation the tenant shall keep the premises and contents thereof in good order and condition, and at the termination thereof return the entire premises and contents in the same good order and condition as they were at the commencement of occupation by the tenant. The tenant shall be responsible for all costs of any breakages or damage to the leased premises and its contents.
6. Bloomberg Luxury Rentals CC accepts no liability whatsoever in respect of any theft, loss, damage, accident or injury to the tenant, its invitees or any third person using the leased premises whether due to any negligence on the part of Bloomberg Luxury Rentals CC, their agents, their staff or otherwise. The tenant will under no circumstances have any claim against Bloomberg Luxury Rentals CC for consequential loss howsoever caused. The tenant hereby indemnifies Bloomberg Luxury Rentals CC against any claim of this nature made against Bloomberg Luxury Rentals CC by any person who is not a party to this rental agreement.
7. A domestic cleaning service will be provided. A washing & ironing service for clothing is provided at extra charge (Please speak to the property manager for related charges.) Cleaning staff work from 9.30am to approximately 12.30pm Monday to Friday.
8. Please provide your own beach towels as towels from the premises are not to be removed.
9. Note that no parties or noise is permitted that may offend the neighbours or contravene any Law.
10. There will be an R 500.00 charge per set of keys not returned to this office.
11. The tenant shall pay an acceptable form of security with Bloomberg Luxury Rentals CC to cover telephone charges during tenancy which security shall be returned to the tenant on settling of the telephone charges. (Not Applicable with pay as you go phones)
12. This agreement shall be governed and construed by the laws of the Republic of South Africa.
13. The tenant hereby chooses domicillium citandi et executandi for all purposes at the leased premises and accepts the jurisdiction of the Magistrate’s Court, Cape Town for the purpose of any action against him/her in terms of this rental agreement and further agrees that he/she shall be liable for any legal costs incurred in respect of any action instituted against him/her for the recovery of any outstanding amount in terms of this rental agreement on the attorney and client scale including collection commission.
14.OWNER'S OBLIGATIONS
14.1 If there are any alterations or changes to the premises or neighbouring properties (including renovations, refurbishing or reconstructions) which may in any way or manner inconvenience, dissatisfy and conflict with the original expectation of the tenant, then Bloomberg Luxury Rentals CC is obliged to notify the tenant in advance.
14.2 Bloomberg Luxury Rentals CC shall by no later than last working day prior to the arrival of the guests ensure that:
14.2.1 the premises shall be made available in good and immaculately clean condition and prepared for the tenants’ arrival, and all fittings, appliances, equipment and amenities shall be in sound working order;
14.2.2 any remote controls, security alarm codes and keys for internal and external doors, gates and garage doors are made available to the tenant, are clearly marked and are in working condition;
14.2.3 the premises are adequately insured against damage and/or destruction;
14.2.4 there is sufficient clean crockery, cutlery, clothes hangers, towels, bedding and linen for all occupants;
14.2.5 the telephone, electricity and water accounts and the accounts of the other services such as gardening and pool services, if applicable, shall be paid up and that there shall be an uninterrupted supply of the services;
14.2.6 the premises are let with all the furnishings, fittings, appliances, equipment and amenities as offered to the tenant.
